These cases are commonly resolved in Oklahoma courts in one of the following ways:
- Adverse possession: If you occupy property that belongs to someone else exclusively and openly for fifteen years or more, you can go to court, prove it and you become the owner of the property. Additional elements must be proven, but in general terms possession is the key.
- Boundary by acquiescence: Similar to adverse possession, if you have a fence that is in place for fifteen years or more and the owners on each side of the fence have acted like it is the property line, the court can make it the new legal property line.
These disputes typically arise when one of the property owners sells or wants to sell their property and a new GPS survey is performed. Advances in survey technology have resulted in many old property lines being determined to be off.
